Our Terms and Conditions

1. General

These terms and conditions apply to all experiences, activities, and services provided by Destinasjon 71 Grader Nord AS (“organizer”). By making a booking, the customer confirms that they have read and accepted these terms and conditions.

2. Booking and Agreement

A booking is considered binding when:

  • payment has been made, or
  • the offer has been accepted in writing

For group bookings, the agreement is valid from the time the offer is confirmed in writing. Upon completion of the booking, a binding agreement is entered into between the customer and the organizer.

The organizer undertakes to deliver the ordered products or services, while the customer assumes financial responsibility for the booking.

The person placing the order simultaneously confirms that they are authorized to act on behalf of themselves and any traveling companions. This includes responsibility for payment on behalf of the entire travel group.

The person placing the order is also responsible for verifying that the reservation matches what was ordered, as well as for keeping all members of the travel group informed about the details of the order and any changes.

3. Payment

Individual Bookings

  • Full payment upon booking

Group bookings

  • Payment can be made by credit card, voucher, or invoice
  • Invoices typically have a 10-day payment term

Agreed prices are binding on both parties. Goods and services beyond the scope of the contract will be charged according to the current price list. The organizer reserves the right to adjust prices as a result of changed costs due to increased taxes, fees, or other circumstances beyond the organizer’s control. Payment shall be made in accordance with the contract.

4. Price adjustments

All prices are subject to change. After a booking is confirmed, the price may only be adjusted up to 20 days prior to the event due to:

  • changes in public fees and taxes
  • increased transportation costs
  • significant price increases for raw materials or inputs, including king crab

If a price increase exceeds 10% of the agreed price, the customer has the right to cancel the order with a full refund.

5. Cancellation

Individual orders

  • Up to 7 days before the start: free cancellation
  • 7 days or less before the start: no refund

Group bookings

  • 30 days or more: free cancellation
  • 29–15 days: 30% of the total amount will be charged
  • 14–8 days: 50% of the total amount charged
  • 7 days or less: 100% charged

A reduction in the number of participants exceeding 20% is treated as a partial cancellation. Cancellations must be made in writing.

6. Changes to the booking

Changes to the booking must be notified in writing and are subject to availability.

For groups:

• The final number of participants must be confirmed no later than 24 hours before the
start• After this, the confirmed number will be billed in full

7. Conduct of Activities

All activities take place in an Arctic environment and may be affected by weather, wind, and natural conditions. In the event of challenging weather conditions, the organizer reserves the right to:

  • change the program, route, or schedule
  • substitute the activity with a comparable alternative
  • cancel the activity for safety reasons

Such changes do not entitle the participant to a refund if the experience is essentially maintained.

8. Force Majeure

The organizer may cancel or change activities due to circumstances beyond our control, including:

  • weather conditions
  • natural disasters
  • technical issues
  • government orders

In such cases, we offer:

  • an alternative activity
  • a new date for the event
  • or a refund

The organizer is not liable for any further compensation.

9. Participants’ Responsibilities and Obligations

Participants are required to:

  • arrive punctually at the agreed time
  • follow instructions given by the organizer
  • be considerate toward other participants
  • assess whether they are physically and mentally fit to participate in the booked activities

The organizer may refuse participation if:

  • safety cannot be ensured for the participant or other participants
  • the participant is under the influence of or suspected of being under the influence of alcohol or drugs
  • the participant behaves irresponsibly

10. Safety and Participation Requirements

General

  • Participation is at your own risk
  • Good general health is recommended for participation in ATV, RIB, and snowmobile activities.
  • When using motorized vehicles (ATVs, snowmobiles) and participating in RIB tours, Norwegian regulations regarding alcohol consumption apply.

ATV

  • A valid Class B driver’s license is required to drive an ATV and must be brought to the activity
  • The use of a helmet is mandatory for both the driver and passenger
  • Maximum of two people per ATV
  • The maximum total weight per ATV is 250 kg
  • The minimum age for participating in ATV activities is 12 years
  • The minimum height for participating in ATV activities is 125 cm
  • Participants under 16 years of age must be accompanied by a responsible adult
  • Upon arrival, ATV safety instructions will be reviewed. These must be read and confirmed as understood with the participant’s signature before the tour begins.

RIB

  • Life jackets must be worn on board
  • The maximum weight per participant is 140 kg
  • The minimum age for participating in the RIB is 6 years
  • The minimum height for participation on the RIB is 125 cm
  • Participants under 16 years of age must be accompanied by a responsible adult
  • Upon arrival, RIB safety instructions will be reviewed. These must be read and confirmed as understood with the participant’s signature before the trip begins.

Snowmobile

  • A valid Class S or B driver’s license is required to drive on our snowmobile safaris and must be brought to the activity
  • The use of a helmet is mandatory

11. Delays and Check-in

The meeting time is 10 minutes before the tour starts.

In case of delay or no-show:

  • the tour will proceed as planned
  • no refunds will be given

The organizer cannot be held liable for losses, delays, or non-participation if a guest does not arrive at the agreed-upon start time for activities, programs, accommodations, or other services. This also applies in cases where the delay is due to circumstances beyond the guest’s control (force majeure), such as delayed or canceled flights, road closures, severe weather conditions, or other unforeseen events.

It is the guest’s own responsibility to allow sufficient travel time and to account for possible delays. Services not utilized as a result of late arrival will not be refunded.

12. Liability and Insurance

The organizer has liability insurance through the insurance company Fremtind. Participants must also have valid travel insurance.

The participant is liable for damage caused to:

  • equipment
  • vehicles
  • facilities

if this is due to negligent or intentional acts by participants. In the event of damage to a vehicle, the participant will be charged the deductible specified in the liability waiver signed before the trip begins.

The organizer cannot be held liable for losses and additional costs resulting from delays beyond the company’s control, such as strikes, accidents, illness, or other circumstances falling under force majeure.

The organizer is not responsible for valuables brought by participants, such as phones, glasses, cameras, bags, clothing, etc.

If a participant chooses to withdraw from one of our activities of their own volition, the participant is not entitled to a refund.

13. Privacy

When making a booking, the customer must provide the necessary information to complete the booking. Personal data is processed in accordance with applicable privacy legislation (GDPR).

Information is used solely for:

  • processing the order
  • legal requirements

Our employees and partners are bound by confidentiality and applicable privacy laws.

You have the right to:

  • access to stored personal data
  • have incorrect information deleted

Please notify us if your information changes.

14. Complaints

Any complaints regarding the service must be submitted in writing no later than 7 days after the event has taken place. Complaints received after this deadline will not be processed or provide grounds for financial compensation.

15. Disputes

Any disputes between the participant and the organizer shall be resolved at the organizer’s place of jurisdiction.
